Sinaloa Cartel: Judge Imposes 60-Day Deadline to Charge Javier "El JT" Torres Félix

A federal judge gave the Office of the Attorney General 60 days to the PGR to state what will be the legal fate of drug Lord Javier Torres Félix, El JT, who was second in command in the Sinaloa cartel, after the boss Ismael El Mayo Zambada [what about that Chapo guy?].

JT served a sentence in the United States after being extradited in 2006, for crimes comparable to organized crime and drug trafficking, but in November 2013 he was deported back to Mexico and arrested by the PGR.

However, as the federal Public Ministry agent has not acted on the exercise of criminal action against Torres Félix, this is person protected and won the judgment on the first appeal in the fifth district amparo criminal court.

In it's judgment in 935/2013, issued on December 31, 2013, the judges said that while it is true that neither the Constitution nor the law established a period of time for the prosecutor to issue charges;

"Every time that the effects of such failure are the same or even more serious that occur with an express resolution of no exercise or discontinuance of criminal proceedings, being that in the rule of law it cannot accept is that the aforementioned ministerial authority indefinitely deferred the resolution at the request of the governed", said the judge.

On 27 January 2004, the Mexican army arrested El JT during an operation in Culiacán, Sinaloa; This person liked to show off handling different types of firearms, this was known at the time by the Secretary of national defense.

In the six years time period in which he was captured (2000-2006), the military captured the primary leaders of drug trafficking in Mexico: Osiel Cardenas Guillen, leader of Los Zetas and the Gulf cartel; Benjamín Arellano Félix, leader of the cartel of Tijuana, and Armando Valencia Cornelio, the chief of Los Valencia.

They also arrested Miguel Angel Guzmán Loera (brother of El Chapo, and Carlos Rosales El Carlitos, who prepared an assault to the prison of La Palma maximum security prison, to rescue his friend Osiel. In October 2012, soldiers in Sinaloa took down José Manuel Torres Félix, El M1 or El Ondeado, brother of El JT.

José was the Chief Lieutenant of El Mayo Zambada, the capo who runs, along with El Chapo Guzmán, the Sinaloa cartel.

The Sedena informed that since 1990, José Manuel Torres Félix was part of this criminal group and after the capture of his brother Javier Torres, in January 2004, El Mayo appointed him as his Lieutenant.
 

TRIAL

Torres began the trial asking the court to through out the complains of agents of the MP attached to the unit specialized in terrorism research, collection and traffic of weapons of the Seido because it has not acted in the preliminary investigation PGR, SIEDO, UEITA, 087, 2009, against him.

The judge said: "certainly the responsible from the 1 of July of 2009 ministerial authority, until the date on which the present judgment of amparo (December 30, 2013), resolves has done various actions related to breaches investigated, the latest being the one held April 19, 2013; However, it is necessary to make this institution that the denounced offences apply without delay... Hence the founded of the considerations expressed by the complaining party."
